SynapseRx Psych Terms of Use

These Terms of Use (“Terms”) govern access to and use of the SynapseRx Psych website, beta preview, account and subscription features, browser-based tools, mobile app, content, and related services (collectively, the “Service”). By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

Eligibility and intended users

The Service is intended for healthcare professionals, adult students, educators, and supervised trainees in psychiatry and related fields. You must be legally able to agree to these Terms and must use the Service within your training, licensure, supervision, scope of practice, organizational policy, and applicable law.

Clinical, diagnostic, medication, and emergency limitations

• The Service does not provide medical advice, diagnosis, treatment, prescribing, medical necessity determinations, or an emergency response service for any individual.
• Screening scores, DSM/ICD tools, diagnostic possibilities, timelines, interaction checks, medication comparisons, treatment algorithms, monitoring prompts, and care-plan drafts are decision-support aids and may be incomplete or incorrect.
• Always independently verify dosing, warnings, contraindications, interactions, monitoring, pregnancy/lactation information, age restrictions, approvals, recalls, REMS requirements, and other clinical information using current authoritative sources.
• For emergencies or imminent safety concerns, use appropriate emergency services, crisis resources, facility protocols, and direct clinical assessment. Do not rely on SynapseRx to detect or manage an emergency.

No EHR, PHI storage, or compliance guarantee

The Service is not an electronic health record, legal record, e-prescribing system, claims system, or substitute for an organization’s approved documentation and security systems. Do not enter PHI or direct patient identifiers. Unless separately agreed in writing, SynapseRx does not provide a business associate agreement or warrant that browser Saved Work satisfies HIPAA, record-retention, audit, security, documentation, payer, or professional requirements.

For the current no-PHI release model, server-side database storage is limited to account/access functions and Discussion Board operation if that feature is enabled. Care plans, favorites, saved medications, HPI/workspace data, generated notes, screening results, exports, and similar clinical workspace content are intended to remain local to the user’s browser or device unless a future feature clearly states otherwise.

Acceptable use

You agree not to:

• Use the Service outside lawful professional, educational, or supervised purposes, or represent an output as independently verified when it has not been reviewed.
• Enter PHI, patient names, full dates of birth, medical record numbers, addresses, phone numbers, insurance identifiers, photographs, copied chart text, screenshots, documents, or other direct identifiers.
• Post patient-specific clinical details to the Discussion Board. Discussion Board examples must be generalized, fictionalized, or otherwise de-identified and must not contain information that could reasonably identify a patient.
• Attempt to bypass access controls, probe security, introduce malicious code, interfere with operation, scrape at unreasonable volume, or use another person’s credentials.
• Copy, resell, republish, reverse engineer, or commercially exploit proprietary Service content or software except as permitted by law or written authorization.
• Use the Service or its output to violate law, professional duties, intellectual-property rights, privacy rights, payer rules, or institutional policy.

Automated outputs, sources, and user responsibility

Generated or structured notes, care plans, patient instructions, diagnostic suggestions, prior-authorization text, billing prompts, documents, and other outputs are drafts. You are responsible for reviewing, editing, verifying, approving, and securely transferring any output before use. A displayed citation, source link, status indicator, or completeness check does not guarantee accuracy, currency, applicability, or completeness.

Drug information, labeling, evidence, guidelines, codes, payer rules, and product availability change. The Service may contain errors, omissions, delays, or broken third-party links. You are responsible for using current official sources and exercising independent judgment.

Saved Work, exports, and data loss

Browser Saved Work, care plans, favorites, saved medications, HPI/workspace data, generated notes, screening results, exports, and similar clinical workspace content are stored locally and are not automatically backed up to a SynapseRx account. They may be lost when browser data is cleared, private browsing ends, storage is evicted, or devices, browsers, or profiles change. You are responsible for retaining required records in an approved system and safeguarding exports and encrypted backups. SynapseRx cannot recover local data or a forgotten backup passphrase.

Accounts, beta access, subscriptions, and payments

Accounts are for one individual user. Do not share your login, password, invite, beta access, subscription, or account credentials with another person, and do not use another person’s credentials. Organization, classroom, team, or practice access requires separate named accounts unless SynapseRx expressly agrees otherwise in writing.

You are responsible for accurate account information, credential confidentiality, and activity under your account. SynapseRx may require re-verification, revoke sessions, restrict posting or paid access, suspend an account, or require a password reset when account sharing, credential compromise, payment misuse, suspicious activity, or other security risk is suspected. Beta access is limited, may expire, may change without notice, and may contain incomplete or experimental features.

Paid plans, trials, renewals, cancellation timing, taxes, refunds, and billing are presented during checkout or by the applicable app store or payment provider. Unless the checkout terms state otherwise, subscriptions may renew automatically until canceled through the applicable billing channel. Feature names, plan placement, pricing, and availability may change. Consumer rights that cannot lawfully be waived remain unaffected.

Third-party services and links

The Service may use or link to third parties such as Netlify, Clerk, Stripe, Google Analytics, app stores, FDA/DailyMed, publishers, manufacturers, and external education or support resources. Third-party services are governed by their own terms and policies. SynapseRx does not control and is not responsible for third-party content, availability, security, or practices.

Intellectual property and feedback

The Service, branding, software, organization, original content, and design are owned by SynapseRx or its licensors and are protected by applicable intellectual-property laws. Limited personal or internal professional use does not transfer ownership. Third-party names and materials remain the property of their respective owners.

If you voluntarily send non-confidential feedback or suggestions, you permit SynapseRx to use them to evaluate and improve the Service without restriction or compensation. Do not submit PHI, confidential patient information, or material you lack authority to provide.

Suspension, termination, and changes

SynapseRx may modify, suspend, restrict, or discontinue the Service or access to it when reasonably necessary for security, maintenance, legal compliance, misuse, nonpayment, product changes, or business reasons. You may stop using the Service at any time and may manage account or subscription status through available channels.

Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, completeness, currency, merchantability, fitness for a particular purpose, noninfringement, uninterrupted availability, security, clinical effectiveness, reimbursement, or regulatory compliance. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, SynapseRx and its contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, revenue, profits, or goodwill; clinical decisions or patient outcomes; billing or payer consequences; or unauthorized access arising from or related to use of or inability to use the Service. Liability that cannot lawfully be limited remains unaffected.

General terms

If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement governing the Service unless separate written terms apply. You may not assign your rights under these Terms without consent; SynapseRx may assign them in connection with a reorganization, financing, merger, acquisition, or asset transfer. Applicable law controls any rights that cannot be modified by contract.

Changes to these Terms

These Terms may be updated as the Service or legal requirements change. The effective date above identifies the current version. Continued use after updated Terms become effective constitutes acceptance where permitted by law; when legally required, additional notice or consent will be provided.
